1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts, deliveries and services of Aquavital GmbH (hereinafter "Seller") concluded via the website aquavital.ch, by telephone, by email or by any other means.
1.2 Deviating, conflicting or supplementary terms and conditions of the Buyer shall not become part of the contract unless the Seller expressly agrees to their applicability in writing.
1.3 These GTC apply to both consumers (Part B) and businesses (Part C) within the meaning of the Swiss Code of Obligations (CO). Where Parts B or C contain differing provisions, those provisions shall take precedence over the provisions of Part A.
1.4 The version of these GTC valid at the time of conclusion of the contract shall apply.
2.1 The presentation of products on the website does not constitute a legally binding offer but rather a non-binding invitation to place an order (invitatio ad offerendum).
2.2 By submitting an order, the Buyer makes a binding offer to enter into a purchase contract. The Seller shall confirm receipt of the order without delay by email. This acknowledgement of receipt does not constitute acceptance of the contract.
2.3 The contract is only concluded upon the dispatch confirmation or an express declaration of acceptance by the Seller.
2.4 The Seller reserves the right to decline orders without stating reasons.
3.1 The Seller distributes physical water treatment devices under the Aquavital brand (hereinafter "Limescale Magnet"), manufactured by Aquavital GmbH, Austria. The products are designed for physical water treatment in buildings.
3.2 The Limescale Magnet does not remove limescale (calcium) from the water. The operating principle is based on changing the crystal structure of the calcium dissolved in the water (conversion of calcite to aragonite), thereby reducing limescale deposits. The mineral content of the water remains unchanged.
3.3 Transparency notice: The effectiveness of physical water treatment is to some extent debated in mainstream science. The Seller notes that some of the described effects are not considered fully established by parts of the scientific community. The satisfaction of over 140,000 customers and numerous practical reports attest to the effectiveness of the products.
3.4 The products are available in the following versions:
4.1 All prices are stated in Swiss Francs (CHF), inclusive of the statutory value added tax (VAT) and inclusive of shipping costs within Switzerland.
4.2 The following package prices apply (as of March 2026):
4.3 A 3% early payment discount is granted for payment within 14 days of the invoice date.
4.4 The Seller reserves the right to change prices at any time. For contracts already concluded, the price agreed at the time of the order shall apply.
5.1 The Seller offers its customers a free trial period of 30 days from receipt of the product. There is no purchase obligation during the trial period.
5.2 The Buyer may install, commission and test the product during the trial period. If the Buyer is not satisfied, they may return the product to the Seller free of charge within the trial period. The Seller bears the cost of return shipping.
5.3 If the Buyer does not return the product within the 30-day trial period and does not make an express declaration of return, the purchase contract shall be deemed concluded. The Seller shall then invoice the Buyer for the agreed purchase price.
5.4 If, after expiry of the trial period, the Buyer cannot be reached despite multiple contact attempts (at least two attempts by telephone and email) and has not returned the product, an invoice for the agreed purchase price shall be sent. The payment terms set out in § 6 shall apply.
5.5 Note: Unlike the EU, Switzerland does not provide a statutory right of withdrawal for distance selling contracts. The 30-day trial period is granted voluntarily by the Seller as an additional benefit.
6.1 The purchase price is due within 30 days of the invoice date after expiry of the trial period, unless otherwise agreed.
6.2 A 3% early payment discount is granted for payment within 14 days of the invoice date (see § 4.3).
6.3 If the Buyer is in default of payment (Art. 102 ff. CO), the Seller is entitled to charge default interest of 5% p.a. (Art. 104 CO) after an unsuccessful reminder, as well as reasonable reminder costs.
6.4 The Seller accepts the following payment methods: bank transfer, PayPal, credit card (via Stripe).
7.1 Delivery is made within Switzerland and the Principality of Liechtenstein via Swiss Post (Die Post).
7.2 The delivery time is generally 3–5 working days from the dispatch confirmation.
7.3 Shipping costs are included in the purchase price (see § 4.1).
7.4 The risk of accidental loss or deterioration passes to the Buyer upon handover. In the case of shipping, the risk passes to the Buyer upon handover to the carrier, unless the Buyer is a consumer – in which case the risk only passes upon actual delivery to the Buyer.
8.1 The delivered goods remain the property of the Seller until full payment of the purchase price (retention of title pursuant to Art. 715 SCC).
8.2 The Seller is entitled to have the retention of title registered in the retention of title register at the Buyer's place of residence. The Buyer hereby grants consent to the registration.
8.3 During the existence of the retention of title, the Buyer is prohibited from pledging or assigning the goods as security.
9.1 In addition to the statutory warranty, the Seller grants a voluntary 90-day money-back guarantee from the date of product receipt.
9.2 If the Buyer is not satisfied within 90 days of receiving the product, they may return the product to the Seller. The Seller shall refund the full purchase price upon receipt of the returned goods.
9.3 The Seller bears the cost of return shipping. Returns are processed using a return label provided by the Seller.
9.4 The product must be returned in a condition consistent with normal use during the trial and guarantee period. Normal signs of use do not diminish the right to a refund.
9.5 The refund is made within 14 days of receipt of the return via the same payment method used for the original payment, unless expressly agreed otherwise.
9.6 This guarantee is granted voluntarily and exists independently of the statutory warranty. It does not establish any rights beyond those expressly stated.
10.1 The warranty is governed by the provisions of the Swiss Code of Obligations (Art. 197 ff. CO).
10.2 The Buyer must inspect the goods immediately upon receipt and report any defects without delay (Art. 201 CO). If the Buyer fails to report defects in a timely manner, the goods shall be deemed accepted.
10.3 In the event of a justified defect report, the Seller has the right, at its discretion, to repair, replace or refund the purchase price (rescission pursuant to Art. 205 CO or price reduction pursuant to Art. 205 CO).
11.1 In addition to the statutory warranty, the Seller grants – on behalf of the manufacturer Aquavital GmbH – a voluntary guarantee of 50 years on the materials and function of the Limescale Magnet from the date of purchase.
11.2 The guarantee covers defects in materials and function that occur during intended use and proper maintenance (see § 12).
11.3 The guarantee does not cover:
11.4 In the event of a guarantee claim, the defective device shall be repaired free of charge or replaced with an equivalent device. Return and re-shipping costs are borne by the Seller.
11.5 Guarantee claims are to be submitted by email to or by telephone at +41 76 391 03 94.
12.1 To maintain the optimal function of the Limescale Magnet, the device must be removed from the water pipe twice a year for 24 hours to demagnetise and regenerate its effectiveness.
12.2 Installation and removal can be performed without tools and without specialist knowledge.
12.3 Failure to perform regular maintenance may impair the effectiveness of the product and jeopardise the guarantee pursuant to § 11.
13.1 The Seller is liable for damages only in cases of intent and gross negligence. In cases of slight negligence, the Seller is only liable for breach of material contractual obligations (cardinal obligations), limited to the foreseeable, typical contractual damage.
13.2 Liability for indirect and consequential damages, in particular for loss of profit, is – to the extent permitted by law – excluded.
13.3 The above limitations of liability do not apply to damages arising from injury to life, body or health, nor in cases of mandatory statutory liability.
13.4 The Seller assumes no liability for damage to pipes, appliances or building installations that is not attributable to a defect in the Limescale Magnet.
14.1 The Seller processes personal data of the Buyer in accordance with the Federal Act on Data Protection (nFADP) and the Data Protection Ordinance (DPO).
14.2 Details of data processing can be found in the privacy policy at aquavital.ch/en/privacy.
14.3 The Buyer's contact details are used for contract processing, delivery and – subject to consent – for sending information about products and services.
15.1 These GTC and all legal relationships between the Seller and the Buyer are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict of laws provisions.
15.2 The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC is Chur, Canton of Grisons, Switzerland. For consumers, the mandatory statutory jurisdictional provisions of the Swiss Code of Civil Procedure (CPC) shall apply.
16.1 Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the valid provision that most closely approximates the economic purpose of the invalid provision shall be deemed agreed (severability clause).
16.2 Amendments and additions to these GTC must be made in writing. This also applies to the waiver of this written form requirement.
16.3 The Seller reserves the right to amend these GTC at any time. For existing contracts, the GTC valid at the time of conclusion of the contract shall apply.
The following provisions apply in addition to Part A for contracts with consumers (natural persons who enter into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity).
17.1 Switzerland does not provide a statutory right of withdrawal for contracts concluded by distance selling (unlike EU law). The right of return during the 30-day trial period (§ 5) and the 90-day money-back guarantee (§ 9) are granted by the Seller voluntarily and without statutory obligation.
17.2 The consumer may exercise the trial period by written notice (email is sufficient) to or by telephone at +41 76 391 03 94.
18.1 The Seller undertakes not to engage in unfair business practices within the meaning of the Federal Act against Unfair Competition (UCA) in its dealings with consumers.
18.2 In particular, all product characteristics and performance claims are presented truthfully and transparently (see § 3.2 and § 3.3).
19.1 The warranty is governed by Art. 197 ff. CO. The statutory limitation period for defect claims is two years from handover of the goods (Art. 210 para. 1 CO).
19.2 The voluntary 50-year guarantee (§ 11) and the 90-day money-back guarantee (§ 9) exist independently of and in addition to the consumer's statutory warranty rights.
19.3 Mandatory statutory rights of the consumer remain unaffected in all cases.
20.1 For actions against consumers, the court at the consumer's place of residence or at the Seller's registered office (Chur) has jurisdiction.
20.2 The consumer may sue the Seller at its registered office (Chur) or at their own place of residence (Art. 32 CPC).
The following provisions apply in addition to Part A for contracts with businesses (natural or legal persons or partnerships with legal capacity who act in the exercise of their commercial or independent professional activity when concluding the contract).
21.1 The warranty is governed by Art. 197 ff. CO. The business must inspect the goods immediately upon receipt and report obvious defects immediately, and hidden defects without delay upon discovery (Art. 201 CO).
21.2 The limitation period for defect claims is one year from handover of the goods (Art. 210 para. 1 CO), unless the 50-year guarantee (§ 11) grants more extensive rights.
21.3 In the event of a defect, the Seller is entitled, at its discretion, to repair, replace or rescind the contract.
22.1 The Seller's liability towards businesses is – to the extent permitted by law – limited to the net invoice value of the affected delivery.
22.2 Liability for loss of profit, indirect and consequential damages is – to the extent permitted by law – excluded.
22.3 The limitations of liability do not apply in cases of intent, gross negligence or injury to life, body or health.
23.1 The delivered goods remain the property of the Seller until full satisfaction of all claims of the Seller arising from the ongoing business relationship (extended retention of title, Art. 715 SCC).
23.2 The business is obliged to treat the goods subject to retention of title with care and to insure them adequately against fire, water and theft.
24.1 The exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is Chur, Canton of Grisons, Switzerland.
24.2 The Seller is additionally entitled to sue the business at its registered office.
25.1 In the event of default of payment (Art. 102 ff. CO), the Seller is entitled to charge default interest of 5% p.a. (Art. 104 para. 1 CO).
25.2 The right to claim further default damages is reserved.
25.3 In the event of the business's default of payment, all outstanding claims of the Seller shall become immediately due and payable.
